These terms will be governed by and construed in accordance with the law of England and Wales, in particular the Licensing Act of 2003 in relation to the Legal Minimum Age.
No photography, imagery, text, source code or any other material shown on Brandyclassics website (www.brandyclassics.com) may be used in any circumstances for commercial purposes, nor may any of our material herein be altered, cropped, transformed, built upon, or in any other way changed or reproduced, whether from our own websites or copied from third party websites in breach of this condition themselves or otherwise redistributed without our prior written permission.
Brandyclassics is not responsible for the views expressed by customers or independent tasters in the tasting notes or product reviews sections of the website. Brandyclassics are not responsible for any disruption, offence or damage caused by following any links from Brandyclassics to any third-party websites.
3. Payment Methods
Payment can be made by debit or credit card online, using the following cards: VISA, VISA Debit, Visa Electron, Mastercard, Solo or UK Maestro. You must give us authority for payment at the time of order. All card holders are subject to validation checks and authorisation by the card issuer. We will not deliver any Products prior to these checks and authorisations being completed. If your card issuer refuses to authorise payment to us, we cannot accept your order, and will not be liable for any delay or non-delivery. You can also pay by bank transfer if you wish by prior arrangement, in which case you must contact us before sending any money. Please be aware that there may be an administration charge for this service depending on the country of origin. Your bank may also charge you for this service.
4. Cancellation and Returns Policies
It is the policy of Brandyclassics to ensure that all products supplied to our customers arrive in perfect condition. You have the right to cancel your order without charge. If you are not happy with any brandy products purchased which are not faulty or opened, we will happily refund your money or exchange the products provided you inform us within 5 days following the delivery of the goods.
Any returned products must be returned to us in good condition, with all the packaging intact. Any refunds or reimbursements will be paid within 30 days of the return of any such unsatisfactory goods. Should any goods be returned in an unsatisfactory condition a charge will be made to the sender. Any product returned must be within its original packaging and adequately packed to avoid any possible damage. The cost of returning the product is the responsibility of the customer.
Not all products offered on our web site are in new bottles or presentation material and have been purchased as seen from known and reliable suppliers. Product images on the website are intended for illustrative purposes only and may not be exact representations of the item in stock, particularly for antique and/or discontinued products, which may not be in 100% perfect condition. Please also be aware that batch numbers, vintages and bottling dates may be subject to change. Should this situation occur, we will do all possible to inform you before the item is shipped.
5. Minimum Legal Age
It is against the law to supply people below the legal minimum age in the UK and we can only sell alcohol products to those over the age of 18. By placing an order with Brandyclassics, you confirm that you are at least 18 years of age and live in the UK or that you are above the minimum legal age for purchasing alcohol products in your country of residence.
6. Taxes and Duties
Alcohol products sold at Brandyclassics are subject to UK taxation. If we are sending products to an address within the European Union (EU), prices are subject to Value Added Tax (VAT). This applies to all EU countries except Sweden, where Swedish duty and tax will be added at the time of the sale.
Any products sent to an address outside the EU, we will not charge VAT, although your order may be subject to local taxes and duties upon arrival in your country, which are levied once the package reaches your country. All additional charges for customs clearance are the responsibility of the customer; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, customers will need to contact their local customs office for further information.
Full and proper invoice and delivery address’s must be provided at the time of placing the order Post Office box numbers will not be accepted and any such information will create delays and may incur additional costs. After processing, orders may be subject to delay if any order or part of an order is unavailable, in which case Brandyclassics will notify the customer. All consignments carry a copy of the consignment note and Invoice
Normal deliveries are made by Parcelforce next day deliveries. It is necessary for customers to be present or to make satisfactory arrangements to sign for all deliveries. All deliveries are fully tracked and recorded by Parcelforce and Brandyclassics. Orders will be processed and despatched by the end of the following working day. All orders are despatched using a 24 hour service to most mainland destinations in the UK, 48 hour service and 72 hours to outlying areas of the UK.
For international orders, delivery times vary depending on location. Delivery charges are calculated based on the weight of the product and the destination address. Delivery can be made to the United States of America providing the delivery address is not in one of the following states: Alabama, Alaska, Arkansas, Kentucky, Massachusetts, Mississippi, New Hampshire, North Dakota, Pennsylvania and Utah.
Brandyclassics have no control over deliveries once they have left our premises and are unable to guarantee the punctuality of service provided by our delivery agents, particularly during difficult weather conditions. No refunds are available for late delivery unless special terms have been agreed before shipment. If you require a specific delivery date please ring the office on 01225 863988.
9. Availability & Pricing
Brandyclassics have endeavoured to ensure the accuracy of the information on the site. Should a product be unavailable, we will endeavour to inform you of this promptly. Prices and specifications can change without notice and products are subject to availability.
10. Continuity of Access / Service
Brandyclassics aim to offer our customers the best possible service, but we are unable to accept responsibility for interrupted access to Brandyclassics web site due to technical problems outside of our control. Due to the nature of the Internet, access may be suspended, restricted or interrupted at any time, and we are therefore unable to guarantee entirely error-free access and services.
11. Identity Verification
To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made.
In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
12. Data Protection
Brandyclassics take steps to protect your privacy and support all the requirements of the UK Data Protection Act 1998. The data we collect from you is used solely for the purpose of fulfilling your order or sending you the newsletter. We will never disclose your personal information to any other parties without your consent except to verify your identification as above. Your credit card information is not retained and is completely removed from our system after your order is processed or cancelled. You have every right to know what information has been held in our system.
